CITY OF LIVERMORE ESTABLISHES A TEMPORARY MORATORIUM

ON RESIDENTIAL AND COMMERCIAL EVICTIONS


LIVERMORE, Calif. – Today, City Manager Marc Roberts, acting as the Director of Emergency Services, signed an order establishing a temporary moratorium on residential and commercial evictions resulting from loss of income, increased medical expenses, or childcare needs related to COVID-19. This order will go into effect immediately and will remain in effect through May 31, 2020, unless superseded by another order. The City of Livermore’s local emergency declaration, which was confirmed by the City Council on March 16, 2020, empowered the Director of Emergency Services to make and issue orders and regulations on matters related to the protection of life and property as affected by the local COVID-19 emergency.

Under this temporary moratorium, a landlord shall not evict a residential or commercial tenant for nonpayment of rent if the tenant shows that the inability to pay is due to a significant decrease in income or large out of pocket medical expenses caused by the COVID-19 pandemic, or by any government response to COVID-19. To qualify, the loss of income and medical expenses must be documented in writing. During the term of the order, a landlord is also prohibited from retaliating against a tenant that qualifies for the protections under this order. Nothing in this Order relieves the tenant of liability for the unpaid rent, which the landlord may seek after the expiration of this Order or subsequently enacted Ordinance.

The order establishing a temporary moratorium on evictions will go to the City Council for confirmation at a special meeting on Monday, March 30, 2020. For more information about COVID-19 and the City’s response, visit the City of Livermore website at www.cityoflivermore.net.
